TERMS AND CONDITIONS

By downloading, installing, and/or using the Mologiz Application ("Application"), you agree that you have read, understood, accepted and agreed to these Terms of Use ("Terms of Use" or "Agreement"). If you do not agree with the Terms of Use (as described below) and want to stop using the Service, then please stop using this Application and/or Service. These Terms of Use constitute a legal agreement between you and Mologiz applicable to your visit and use of the Mologiz website at the mologiz.com domain.

The company has the right to change the Terms of Use or other policies related to the Service at any time. Changes to the Terms of Use or Privacy Policy relating to the Service will be effective upon posting of the latest version on the Website. You are deemed to have agreed to the changes to these Terms of Use on a regular basis, even if you review the changes or not.

A. DEFINITIONS

"Mologiz" is PT Modena Logistik Indonesia, a legal entity established and subject to the laws of the Republic of Indonesia ("We" or "Our")

"Transporter" is an individual and/or Indonesian Legal Entity or Indonesian Business Entity who registers and uses Mologiz services in order to be able to offer services to the public.

"Shipper" is a company person and/or Indonesian Legal Entity or Indonesian Business Entity who uses Mologiz services to deliver goods or cargo.

“Goods” means the goods to be sent whether in the form of a container, parcel, parcel, whether one or more are sent as a form of Service.

"User" is every user of Mologiz services, either Transporter or Shipper through the Website or Application.

"Mologiz Services" are all products or services provided by Mologiz including but not limited to software that is operated through the website or application.

"Application" is an application owned by Mologiz which is used to access and use the Mologiz Service via the internet network.

“Website” is Mologiz.com for accessing and using Mologiz Services through the internet. If you are a Shipper, you can register your account at Mologiz.com as a Shipper, if you are a Transporter, you can register your account at Mologiz.com as a Transporter.

B. USE OF THE SERVICE
Before using the Application, you must agree to these Terms of Use and Privacy Policy, and register yourself by providing the information we need. When registering, We will ask You to provide a valid Company name, company address, email and mobile number. You can change your profile information in the settings feature in the Application

After registering, our system will automatically generate a verification code and send a verification code via email to the email address you provided. You must verify by entering the verification code on the registration page in the Application.

After verifying, Our system will create a Mologiz account ("Account") for You to use the Application and order Services through the Application. Your email address is assumed to come from your account so you cannot create a new account with a registered email address.

In the event that you have logged out of your account, you must enter the email address that you provided when registering and enter the verification code, which is then automatically sent by our system to your registered email address, on the login page.

You have full discretion whether to use the Application or other applications, whether to use the Services available on the Application, or stop using the Application.

You can only use the Application when you have registered with the Application. After you have successfully registered yourself, the Application will provide you with a personal account that can be accessed with the password you choose.

We only facilitate you to find the Service you need by providing the Application. All Services are provided directly by independent third parties who agree to become Our partners ("Service Providers"). When using the service, the Application will connect you with the Service Provider. If you are a transporter then we will connect you with the SHipper. If you are a Shipper we will connect you with a transporter.

Furthermore, if the Service Provider receives your order, we will inform you of the status of your order via the Application.

C. SHIPPER TERMS AND CONDITIONS

  • Every Shipping Order and its details made by the Shipper will be registered through the Website. The Shipper can specify certain delivery terms to the Transporter. In this case Mologiz is not responsible for the delivery terms
  • The Shipper can cancel the Delivery Order at any time before it is received by the Transporter. 
  • The shipper must ensure that the goods to be sent are not illegal, dangerous, vulnerable, unsafe, unpleasant, objectionable or any items that are prohibited from being carried based on the applicable laws and regulations in Indonesia.
  • Prior to delivery, the Shipper must advise us of any precautions to be taken to handle the cargo according to its nature.
  • The Shipper is solely responsible for any and all liabilities that occur or are suspected to occur as a result of the goods being sent, including but not limited to property damage, bodily injury or death.

D. TRANSPORTER TERMS AND CONDITIONS

  • The Transporter has completed the registration process with Mologiz and has provided a copy of the valid legal permit to Mologiz
  • The transporter must provide all the equipment and documents required for the implementation of delivery services and must maintain all the equipment in good condition.
  • The Transporter must immediately proceed to collect the Delivery Order within 120 to 180 minutes of receipt of the Delivery Order. The acceptance period can be extended or reduced in accordance with the agreement between the Shipper and the Transporter.
  • The Transporter may not claim, and hereby waive the right to demand, any lien in any delivery.
  • Transporters are prohibited from contacting Shippers directly to execute Shipping Orders without going through the Website.

E. PRIVACY OF PRIVACY

  • Any information contained on the Mologiz Website or Application is fully owned by Mologiz.
  • Mologiz will maintain the confidentiality of all User personal data obtained through the use of the Mologiz Service.
  • Service Users declare that the Personal Information provided by Service Users is true, complete and accurate in accordance with the actual situation.
  • The Service User agrees and agrees to give permission to Mologiz to use his Personal Information to transfer it to the Service Provider so that the Services provided by Mologiz can run. Service Users also give freedom to Mologiz to compile, collect, store and update Service User data in such a way, within the period required during the period of providing Mologiz Services.
  • Service Users agree and agree that the preparation, collection, storage, use and transfer/transfer of Service User data by the Company has been regulated in the Mologiz "Privacy Policy", as stated on the Website. Service Users hereby declare and acknowledge that they have read and understood the Privacy Policy before agreeing to these Terms of Use.

F. SECURITY

  • Mologiz has taken all security measures to ensure system and data security, both technically, organizationally and operationally.
  • Mologiz may temporarily terminate access to the Mologiz Service in the event of a suspected leak or breach of security.
  • If the User feels that there is a leak or violation, the User is obliged to report this matter to Mologiz, and Mologiz will immediately temporarily block the party's access to the Website and/or Application.

G. DEFINITIONS
In the event that Mologiz acts on behalf of the Transporter, the Shipper will pay the freight costs to be agreed by the Transporter which will be determined by Mologiz and the Transporter at a later date.

H. INSURANCE AND COMPENSATION

  • Mologiz provides options for Shippers to use shipping insurance services from Mologiz partner insurance companies, the amount of which is determined later.
  • Mologiz can offer compensation for any loss, damage or destruction of goods and/or cargo that occurs during delivery. The amount of compensation must be in accordance with the market value of the goods and/or cargo which will be determined by Mologiz.

I. CLAIM

  • Mologiz is only a web portal provider and is not the technical person in charge, the Transporter agent is not the organizer of logistics activities. Mologiz's responsibility to Users is limited to providing Mologiz Services to Users through its website and application.
  • All forms of unexpected events and/or losses that arise during transportation are the full responsibility of the User.
  • Mologiz is not responsible for any form of damage/loss/loss/death suffered by the User during transportation and/or caused by the User.

H. MISCELLANEOUS

  • Mologiz may from time to time amend these terms and conditions on "www.Mologiz.com" and they will be binding on you at the time of posting. These terms and conditions will be governed by and construed in accordance with Indonesian law.
  • You submit to the non-exclusive jurisdiction of the Indonesian courts.
  • Mologiz has the right to change the above terms and conditions at any time without prior notification.
